Terms and Conditions

These Terms and Conditions (“Agreement”) govern the relationship between Big Merch Studios and its clients, including schools, organizations, and businesses. By placing an order with us, you agree to the following terms:

1. Non-Refundable Policy

All sales are final. Big Merch Studios operates on a strict non-refundable policy for all products and services, including but not limited to custom t-shirts, apparel printing, and sponsorships. Please review your order carefully before confirming.

  • 1.1 Custom Orders
    Due to the personalized nature of custom apparel, once your order is placed and artwork is approved, it cannot be canceled, refunded, or exchanged. All orders are processed and fulfilled based on the approved artwork and specifications.

  • 1.2 Sponsor-Backed Orders
    For schools, organizations, or any entity participating in the Community Backer Program, sponsorship arrangements are also non-refundable. Sponsors will not be reimbursed after artwork approval or once printing has begun.

2. Payment Terms

  • 2.1 Payment Requirement
    Full payment is required at the time of order placement unless otherwise agreed upon in writing. Orders will not be processed until payment has been received.

  • 2.2 Payment Methods
    We accept the following payment methods: credit cards, bank transfers, and PayPal. No order will be processed until full payment is confirmed.

  • 2.3 Late Payments
    Any late payment or delay may result in postponed production and delivery times. We reserve the right to cancel orders that have not been paid for within the specified time frame.

3. Artwork Approval Process

  • 3.1 Proof Review
    Prior to production, Big Merch Studios will provide a digital proof of the artwork for your approval. It is your responsibility to thoroughly review the artwork for any errors in spelling, design, colors, and sizing.

  • 3.2 Approval Confirmation
    Once the artwork is approved, no further changes can be made. By approving the proof, you acknowledge that the artwork is correct and authorize us to begin production. Big Merch Studios is not responsible for any errors or mistakes after the artwork is approved.

  • 3.3 Color Matching
    While we strive to match colors as closely as possible, variations in color may occur due to differences in screen display and printing processes. By approving the artwork, you agree to accept minor color variations.

  • 3.4 Design Changes
    Any changes requested after artwork approval may incur additional charges. If changes are significant, this may require a new proofing process and could delay production timelines.

4. Production and Delivery

  • 4.1 Production Timeline
    Standard production time is [Insert Number] business days after artwork approval and payment confirmation. Rush services are available for an additional fee, subject to availability.

  • 4.2 Delivery
    We will make every effort to meet the agreed-upon delivery date, but we are not liable for delays due to circumstances beyond our control, including shipping delays or unforeseen production issues.

5. Product Quality and Responsibility

  • 5.1 Quality Assurance
    We take great care in producing high-quality products. If you notice a defect in the materials or workmanship, please contact us within 5 business days of receiving your order.

  • 5.2 Replacement for Defective Items
    If an item is deemed defective, we will replace it at no cost to you. This applies only to manufacturing defects and not to any errors or changes in the approved artwork.

6. Limitation of Liability

  • 6.1 General Liability
    In no event shall Big Merch Studios be liable for any direct, indirect, incidental, or consequential damages arising from the use of our products or services, including but not limited to loss of profit or business interruption.

7. Modifications to the Agreement

Big Merch Studios reserves the right to modify these Terms and Conditions at any time. All changes will be effective immediately upon posting to our website or upon notice via email. Continued use of our services after any modifications indicates your acceptance of the updated Terms and Conditions.

8. Governing Law

This Agreement is governed by the laws of California. Any disputes arising from this Agreement shall be resolved in the courts of California .
